1. Acceptance of Terms
By engaging with TuaTech ("we", "us", "our") for installation services, the client ("you", "your") agrees to be bound by the following Terms of Trade. These terms apply to all quotations, sales, installations, and services provided by us as follows
2. Quotations
- All quotations are valid for [30] days unless otherwise stated.
- Quotes are based on the information provided by the client. Any variations or unforeseen circumstances may result in additional charges or variation expenses.
- Quote varations or changes from initial consult that result in more than 10% change of value before acceptance must be requoted, and accepted by you before commencement.
- Quote varations or changes from initial consult that result in a change of value after acceptance or commencement may be charged at a going rate specified in the rates for the duration of the change and classified as a 'variation', and will be charged sperately on invoices as 'variation'.
3. Pricing and Payment
- All prices are in $NZD and inclusive of GST, with GST being shown seperately.
- A deposit of 50% is required upon acceptance of the quote for values larger than $2000.00 (Two Thousand Dollars), with the full balance due upon completion of work unless otherwise agreed in writing.
- Payment is to be made via accepted payment methods listed on invoices / quotes, and only the listed methods are accepted.
- All invoices are given an invoice number, this must be used as a reference on payment otherwise the payment may not be accepted.
- Late payments may incur a fee of $50 per month, with any and all recovery costs of non-payment to be added to the outstanding amount.
- Part-Payments, installments and scheduled payments are not accepted unless stated in writing or in quotes relating to completion stages eg scope stage, first fix, second fix.
- Hourly Rates are set at $95+GST, incrementing in 0.5h sections.
- Our Hourly Rates are subject to change without prior notice. The applicable rate for your job will be outlined on your invoice / quote. Please refer to your invoice / quote for the current hourly rate applied to your project.
- Minimum 1 hour rate applies from commencement of works, and is charged regardless of the outcome of the works started including reschedulling.
- We charge a vehicle fee and a kilometre rate for sites more than 30kms from (Invercargill) town boundary, as well as a technician rate. This rate may change and will be outlined on your invoice.
- All prices and terms are final, and non-negotiable from acceptance of quote or commencement of works.
4. Scope of Work
- The services provided will be as described in the quote or service agreement.
- Any additional work not specified in the initial agreement will be charged at our standard hourly or project rates and tagged as 'variation'
- Any changes or discoveries made during installation will be communicated in a timely manner for approval to continue.
- For project works, a change management system may be used to control requests and requires approval for each instance before committing.
5. Scheduling and Delays
- We will use reasonable efforts to meet agreed timeframes; however, we are not liable for delays caused by factors beyond our control, including weather, material shortages or supplier delays, restrictions from sites, or inability to install for any reason.
- If we need to reschedule due to unforseen circumstances, we will communicate this to you at the earliest notice.
- Any changes to scheduled installation times must be communicated to us at the earliest notice.
- Reschedulling after commencement of works has begun will incur the minimum rate, see pricing and payments above.
6. Installation Standards
- All work will be performed in accordance with industry standards, relevant legislation, and manufacturer guidelines.
- We warrant our install workmanship for a period of 12 months from the date of completion.
- We do not offer warranty of workmanship beyond reasonable control such as demolition or accidental damages, improper use, neglect, unauthorised alterations, unexpected intereference or electrical surges, and loss of business or productivity from any of these causes.
- Warranties on products are stated by the manufacter and may vary from product to product.
7. Client Responsibilities
- The client must ensure that the worksite is safe, accessible, and free from hazards.
- The client must inform us of any site-specific risks or requirements before work begins.
- The client is responsible for ensuring site access restrictions and necessary permits (if applicable) are available before commencement of works.
- The client is responsible for producing H+S documentation, site specific hazard lists and inductions before commencement of work if necessary
- The client is responsible for advising and outlaying all intended works and hazards such as heights, trenching, confined space, permits, hazardous materials, plant and mechanical movements, site plans, traffic plans, access and restrictions, biological or transmissable hazards, or any other hazard that may be present during the course of works completion.
- The client is responsible for the upkeep and maintenance of products post installation, and may be encouraged to implore a maintenance schedule.
8. Ownership and Risk
- Ownership of goods supplied does not pass to the client until full payment is received. Goods may be removed from site or disabled on non-payment and failure to communicate a payment plan or intentions of payment.
- Risk in goods passes to the client upon delivery or installation.
- Ownership of goods being repaired off-site remain the responsibility of the owner, all reasonable steps of protecting / securing goods off-site will be maintained by the repairer.
9. Cancellations
- Cancellations made within 48 hours of scheduled work may incur a cancellation fee to cover lost time and reschedulling efforts.
- Deposits may be forfeited if the client cancels after materials have been purchased or work has commenced.
10. Liability
- To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages.
- Our liability for any claim arising out of these terms is limited to the amount paid by the client for the services in question.
- All claims of damage must be presented in writing through a claims manager in a timely manner with all relevant documentation
11. Dispute Resolution
- In the event of a dispute, both parties agree to attempt to resolve the issue amicably.
- If a resolution cannot be reached, either party may refer the dispute to mediation or an appropriate tribunal.
12. Privacy
- We collect and store client information solely for the purpose of providing services and will not disclose personal information without consent, except as required by law. This information may be personally identifiable and is handled in a secure way
- Information we collect as follows but is not limited to: Name, address, contact number, email address, roof type, roof material, notes on installation, photographs of final installs
- We do not sell, pass on, or give out any collected information about you for your privacy, to anyone.
- We do not send unsolicited emails or marketting material unless specified you wish to receive
- We may monitor or respond to cloud managed notifications related to your products, and contact you if needed.
- Cloud managed products contain no personal information, or transmitt / relay any communications made on your devices. Cloud managed products are solely for remote mananagement of the devices deployed.
13. Amendments
- We reserve the right to amend these Terms of Trade at any time. The latest version will be available here on our website or provided upon request.
